Terms of Service

By accessing or using The Physics Tutor website, learning management system ("LMS"), educational products, practice materials, or related services (collectively, the "Services"), you agree to these Terms of Service.

If you access the Services on behalf of a school, business, tutoring program, training organization, team, client, or other entity ("Organization"), you represent that you have authority to use the Services on its behalf and to accept applicable terms within the scope of that authority.

A separate quote, invoice, purchase order, license, service agreement, or written contract may contain additional terms. If a separate written agreement expressly conflicts with these Terms, the separate agreement controls for the subject matter it covers.

Users must provide information that is reasonably accurate and current, use only accounts they are authorized to use, and protect passwords, authentication methods, and devices used to access the Services.

Access may depend on an Organization membership, course or program enrollment, invitation, access code, purchase, entitlement, subscription, service season, or other authorization. Possession of an account does not create access to every feature, course, record, or service.

You are responsible for activity conducted through your account unless you promptly notify us that the account has been compromised. You may not sell, rent, transfer, or share account credentials in a manner that defeats access or licensing restrictions.

Organizations may invite users, assign roles, create learning spaces, provide services, manage participation, and control access to Organization-managed information as supported by the Services.

An Organization is responsible for ensuring that it has lawful authority to provide user information, educational records, or content to the Services and to grant the roles and permissions it assigns.

Organization administrators and other authorized personnel may be able to access information associated with their users, courses, programs, or services. Users should understand that an Organization-managed account may be subject to the Organization's own policies in addition to these Terms.

You may not use the Services to:

• Access accounts, records, organizations, courses, or systems without authorization.
• Bypass, defeat, probe, or interfere with authentication, permissions, rate limits, licensing, or security controls.
• Upload malware, destructive code, automated abuse, or content intended to compromise the Services or another user.
• Harass, threaten, impersonate, defraud, exploit, or unlawfully expose another person.
• Use another person's credentials or misrepresent identity, role, authority, enrollment, or entitlement.
• Scrape, copy, redistribute, resell, or systematically extract protected platform content except as expressly permitted.
• Use the Services to violate academic, competition, testing, intellectual-property, privacy, or other applicable rules or laws.
• Attempt to reverse engineer, disrupt, overload, or circumvent technical restrictions except where applicable law expressly permits it.

We may investigate suspected misuse and take reasonable technical or account-level action to protect users and the Services.

Users retain ownership of original content they create and submit to the extent they hold those rights. By submitting content, users grant The Physics Tutor a limited, non-exclusive license to host, store, reproduce, display, transmit, process, format, and otherwise use that content only as reasonably necessary to provide, secure, administer, and support the Services.

This operational license does not transfer ownership of student-authored work to The Physics Tutor. Users should submit only content they are authorized to use.

The Services may preserve submission history, grading records, moderation records, feedback, and audit information. Depending on the feature, original student-authored content may be preserved separately from teacher- or administrator-owned grading, moderation, or feedback actions.

Organizations and instructors are responsible for ensuring that their use of student information, instructional materials, and uploaded content complies with their own obligations and applicable law.

Except for user content and third-party materials, the Services and their original software, interfaces, designs, branding, graphics, written content, question banks, practice tests, instructional materials, templates, and other materials are owned by or licensed to The Physics Tutor and are protected by applicable intellectual-property laws.

Access to the Services gives the user a limited, revocable, non-transferable right to use applicable content for the authorized educational or organizational purpose. No ownership interest is transferred by purchase, account creation, download, or access.

Unless a purchase, license, or written permission states otherwise, users may not publicly post, redistribute, resell, publish, create competing repositories from, or commercially exploit protected materials.

Prices, payment schedules, license periods, quantities, authorized users, service seasons, renewal terms, refund terms, and other commercial conditions may be stated on the website, a quote, invoice, checkout page, purchase order, or separate agreement. Those transaction-specific terms are incorporated into the applicable purchase.

Access to paid digital content or services may be limited by time, Organization, course, user count, service season, product, or other license conditions. Users and Organizations may not intentionally exceed purchased access.

Unless a separate term states otherwise, payment obligations and refund rights are governed by the terms presented or agreed at the time of purchase and applicable law.

Some services may use dedicated workspaces, release periods, service seasons, specialized content, client-specific settings, historical materials, or separate operational rules rather than functioning as a conventional course.

Access to those services may depend on an Organization's entitlement, applicable release, purchase, participation status, or other service-specific authorization. Service-specific terms presented with the applicable program may supplement these Terms.

The Services rely on third-party infrastructure and may link to external educational resources, websites, tools, simulations, or services. Third-party products are governed by their own terms, privacy policies, availability, and security practices.

A link or integration does not mean The Physics Tutor owns, controls, endorses, or guarantees the third party or its content. We are not responsible for changes, outages, or conduct of an independent third-party service beyond our own obligations under applicable law or a written agreement.

Our collection, use, storage, and sharing of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.

If an Organization and The Physics Tutor enter a separate data protection, student-data, or privacy agreement, that agreement controls to the extent it expressly conflicts with these general Terms.

We work to provide reliable Services, but uninterrupted, error-free, or permanently unchanged operation cannot be guaranteed. Maintenance, security work, provider outages, technical failures, legal requirements, or product development may affect availability.

We may add, improve, redesign, replace, limit, suspend, or retire features as the platform evolves, subject to any written contractual commitment that specifically requires otherwise. Where reasonably practicable, material changes affecting paid services may be communicated to affected users or Organizations.

Access may be limited, suspended, or terminated when reasonably necessary because of security concerns, suspected misuse, material violation of these Terms, nonpayment, expired or revoked entitlement, Organization request, legal requirement, account compromise, or threat to users or the Services.

Where appropriate and reasonably practicable, we may provide an opportunity to correct a problem before permanent termination, but immediate action may be taken when needed to address security, abuse, legal obligations, or ongoing harm.

Termination does not automatically eliminate obligations or rights that by their nature should survive, including payment obligations, ownership rights, license restrictions, confidentiality obligations, disclaimers, and lawful retention of records.

The Services are educational tools and resources. They do not guarantee a particular grade, test score, competition result, admission outcome, certification, employment result, academic standing, or other educational outcome.

Users remain responsible for their own work, decisions, academic integrity, compliance with testing or competition rules, and evaluation of whether materials are appropriate for a particular purpose.

Practice questions, instructional materials, generated practice, and explanations may not be identical to materials used by a school, testing organization, competition, credentialing body, or other independent entity unless expressly stated.

To the maximum extent permitted by applicable law and except as expressly stated in a separate written agreement, the Services are provided on an "as available" basis without warranties of uninterrupted availability, error-free operation, or fitness for a particular educational outcome.

To the maximum extent permitted by law, The Physics Tutor will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from use of or inability to use the Services.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. Any specific warranty, service level, or liability term contained in a signed written agreement controls for the subject matter it covers.

If a dispute arises, we encourage the user or Organization to contact us first so the issue can be reviewed and, where possible, resolved informally.

These Terms are subject to applicable law. Any separate written agreement may specify governing law, venue, dispute procedures, or other terms that apply to that relationship.

We may update these Terms when the Services, business practices, or applicable requirements change. The current version will be posted at this page with an updated effective or last-updated date.

Material changes may also be communicated through the website, LMS, email, or an Organization when appropriate. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.
